These Terms of Service (“Terms”) govern your access to and use of the nekos.best website and the NEKOSBEST API (“Service”), operated by NEKOSBEST (“we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.

1. Eligibility ​

You must be at least 13 years old to use the Service.

2. Scope of Service ​

The Service provides access to an API and website that index and redistribute third-party images and GIFs for entertainment and developer use.

The Service is provided free of charge.

3. Content Ownership ​

  • We do not own the images, GIFs, or other media made available through the Service
  • Content is redistributed with attribution to original sources where possible
  • All rights remain with the respective content owners

You are responsible for ensuring your use of the content complies with applicable laws and the rights of the original creators.

4. Acceptable Use ​

You agree not to:

  • Use the Service for any commercial purpose
  • Rehost, resell, or monetize content obtained from the Service
  • Remove or obscure credits or attribution
  • Circumvent rate limits, safeguards, or security measures
  • Abuse, overload, or intentionally disrupt the Service

5. Scraping and Automated Downloading ​

  • Scraping, bulk downloading, or automated extraction of images or GIFs is strictly forbidden
  • This includes scripts or tools designed to mass-download or archive content
  • Caching API responses is permitted only for private use and must not be made public or redistributed

Abuse or violations will result in an API ban.

6. AI and Machine Learning Restrictions ​

You may not:

  • Use content from the Service for training AI or machine learning models
  • Generate or distribute tools or scripts that enable scraping for AI datasets
  • Use the Service in any workflow intended to collect training data

Permission for such use cannot be granted, as we do not own the content.

Violations will result in an API ban.

7. API Usage ​

The API may be subject to:

  • Rate limits
  • Traffic filtering
  • Abuse detection

Abusive usage may result in an API ban.

8. Enforcement ​

Violations of these Terms may result in:

  • Rate limiting
  • Temporary or permanent API bans (IP-based)

No user accounts or API keys are required to use the Service.

9. Disclaimer ​

The Service is provided “as is” and “as available”, without warranties of any kind.

We do not guarantee availability, accuracy, reliability, or error-free operation.

10. Limitation of Liability ​

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of or inability to use the Service.

11. Governing Law ​

These Terms are governed by the laws of Germany, excluding conflict-of-law rules.

12. Severability and Waiver ​

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Failure to enforce any provision shall not constitute a waiver of that provision.

We may update these Terms from time to time.

Changes will be announced via our Discord community.
Continued use of the Service constitutes acceptance of the updated Terms.
